Its various parts focus on the connected theme that some sensible component is essential to the production and comprehension of art. Using the analytic framework of normative logic presented in Fisher, Lovell, and Valero-Silva, provided here are five original business ethics mini-cases that may be used to teach and practice case analysis. We have taken the six questions that are used in the analytic framework of normative logic to solve ethical problems and have adapted them to seven steps that can be applied to conflict resolution of mini-cases in class. Then the adapted normative logic model has seven steps: Describe the “fundamental (...) needs of humankind” as they relate to the case, e.g. caring, supporting, reciprocity, fairness, trust; Explain the established norms, values, and laws that can be seen to apply in this case; State in brief the facts of the situation; Examine the network of circumstances that preceded the situation ; Generate at least three alternative positions and actions open to the actor in the case; Speculate on the hypothesized consequences of the different positions or actions the actor in the case may take; and Choose among the alternative positions the actor in the case might take and give your informed and judged reason for making that choice. A suggested answer is provided for one case, which could be reproduced as a class handout for students to examine after having done their own analysis and having discussed the case as a class. Hegel’s early work The Life of Jesus (Das Leben Jesu) of 1795 presents Jesus as a teacher of Kantian morality and ends abruptly with his death, anointing of his body, and burial, such that Jesus could appear to be merely a figure of the remote past. However, within a few years Hegel’s view of the death of Jesus was to change radically. Writing of his death in terms of the ‘death of God’, this individual is transformed into the universality of (...) Spirit who dwells in the community. This paper examines how this fundamental change in Hegel’s thought came about, how Hegel’s mature understanding of the death of Jesus was appropriated by Richard Wagner in his proposed opera Jesus of Nazareth, and how this ‘death of God’ became the model for the death of Brünnhilde in the Ring cycle. For both Hegel and Wagner, the death of Christ can only be understood as a self-involving enterprise, the bringing together of the ‘objective’ and ‘subjective’. Further, Wagner largely shares Hegel’s immanent understanding of God, although under other influences he can affirm the idea of a transcendent God or a transcendent world. (shrink)

Public and professional debates have come to rely heavily on a special type of reasoning: the argument-from-ignorance, in which conclusions depend on the _lack_ of compelling information. "I win my argument," says the skillful advocate, "unless you can prove that I am wrong." This extraordinary gambit has been largely ignored in modern rhetorical and philosophical studies. Yet its broad force can be demonstrated by analogy with the modern legal system, where courts have long manipulated burdens of proof with skill and (...) subtlety. This legal, philosophical, and rhetorical study by Richard H. Gaskins provides the first systematic treatment of arguments-from-ignorance across a wide range of modern discourse—from constitutional law, scientific inquiry, and moral philosophy to organizational behavior, computer operation, and personal interaction. Gaskins reviews the historic shifts in constitutional proof burdens that have shaped public debate on fundamental rights and, by analogy, on the fundamental status of intellectual and cultural authority. He shows how similar shifts have dominated polemical battles between scientific and ethical modes of authority, affecting both academic and popular discussion. Finally, he discovers the philosophical roots of default reasoning strategies in the arguments of Kant and nineteenth-century Kantian schools. The much more crucial reason for the longevity of the American charcoal iron industry was the technical difficulties involved in adapting coke- and coal-smelted iron to existing industrial processes. Until these technological problems could be overcome, charcoal (...) iron was able to preserve a place for itself in the industrial environment of the late 19th and early 20th centuries. By concentrating their attention on the rapid advance of coke-smelted iron from 1870 onward, historians of the American iron industry have neglected this ability of the older iron technology to adapt to the new industrial conditions. Managerialism is not mere ideology, a concatenation of ideas subsisting in an epiphenomenal superstructure (Überbau) that mirrors economic relations (Base) and masks interests, but a set of practices that, as an extreme manifestation of human resources management (HRM), seeks to constitute the life-world (Lebenswelt) of participants in many sectors of society. Increasingly, it is those at the extremes of elite wealth and marginal poverty who may fall outside its remit and become free to think beyond its parameters. As inheritor of (...) personnel management, HRM as practice and ideology fills a societal vacuum and comes to exercise the power of totalizing social construction. In an integral performance culture the Performative Absolute emerges in the imaginary; it is an immanent sublime that instantiates and regulates the social being of the individual. This apotheosis of the 'manager's right to manage' overrides boundaries between public and private spheres and dissolves the separation of powers. As 'human resource', the employee is subject to living sacrifice; this is an oblation that demands ethical and theological critique. (shrink)

The second part (pp. 75-112) analyzes the relationship of Pascal with Jansenism. Pascal is both dependent on and independent of it. The Jansenists discussed while Pascal felt. Jansenism could not find a stable equilibrium between nature and grace which Jansenism either contrasted or confused while Pascal well distinguishes these two orders. They are for him heterogeneous but the lower order leads to the higher. Without God, man is misery and darkness. With God, man can do all things (p. 118). The third part (pp. 115-219) is entitled The Christian Philosopher. It shows that man is made for the infinite. The true call of humanity is religious (p. 206). This small volume is the first in a new series devoted to bringing to light various figures and aspects of seventeenth-century thought that have either been set aside, forgotten, or are only dimly known. Louis Thomassin (as well as Bernard Lamy who is the subject of the second volume that has appeared in this series) certainly falls in these categories. Although his name often turns up in discussions of Cartesianlsm, Jansenism, Malebranchism, etc., very little consideration is ever given to him as a fairly important personage of the time, or to his ideas and the role they played. This volume by Dr. Clair will be of much use to seventeenth-century scholars in providing the basic data about his life, his connections with several of the vital movements of the period, the fundamental bibliographical materials, as well as publishing two texts and twenty letters not before available. The biographical section (pp. 1-84) traces (a bit too episodically) Thomassin's education, his career among the Oratorians as a professor of humanities, philosophy, and theology, his possible involvements with the Jansenists, his difficulties as a result of his first published work, Dissertations sur les Conciles (1667) (suppressed the same year), his later successes for his many other works in theology, philosophy, history, and pedagogy, and his relations with various major and minor figures of the mid- and late seventeenth century, like Arnauld, Malebranche, Richard Simon, Bayle, Huet, etc. Section II (pp. 85-99) gives a detailed bibliography of Thomassin's published works, plus a list of his manuscripts located in various French libraries. This is followed by twenty letters of Thomassin, an intriguing and interesting discourse on the difference between history and science, and one on the nature of chronology, plus three letters by Thomassin's secretary, Nicolas Barat. In a brief BOOK REVIEWS 265 concluding chapter (pp. 150-52), Dr. Clair deals with "Comment lire l'oeuvre du P. Thomassin," providing much guidance to anyone who wishes to avail himself of the rich resources in Thomassin's writings. From the point of view of the history of philosophy, the most interesting aspects of Thomassin's thought seem to be (1) his "Cartesianism," that is, the extent to which he early imbibed Descartes' new ideas, and played a role in the fusion of the views of Augustine, B6rulle, and Descartes that developed in the Oratory, (2) his attempt to find a viable theory of the nature of Grace somewhere between Arnauld and Malebranche, and (3) his... Professor Margaret Canovan wrote two studies of the work of German-Jewish émigré political theorist, Hannah Arendt. The first, The Political Thought of Hannah Arendt, appeared in 1974, while Hannah Arendt: A Reinterpretation of Her Political Thought was published in 1992. Both were intended for the Anglophone world, especially the US and Great Britain, although Arendt’s reception was more favorable in America where she settled in 1941 than in the UK. An historian of political thought at Keele University, UK, Canovan was (...) ideal to bring Arendt to a general academic audience not to aim at a highly specialized readership deeply grounded in German thought. Though Canovan emphasized the conservative dimensions of Arendt’s thought, her conclusion was, finally, that Arendt’s political thought was a form of modern “republicanism” not an argument for inherited political traditions or a plea for New Left radicalism. Those who campaign for law reform to permit “euthanasia” may seek different things and at least some of what they seek may already be permissible under the criminal law of England and Wales. In this paper I examine one means whereby the criminal law delivers outcomes acceptable to the euthanasia lobby, that is the curious notion of “causation” deployed by the law, which adds a value override to the more usual notion of factual causation such that, for example, if medical (...) treatment falls within the acceptable range as normal and proper, the pre–existing injury or illness is treated as exclusively the cause of death and the doctor escapes criminal liability, even where the medical treatment will shorten life to the certain knowledge, possibly even the wish, of the doctor. Thus the law may already be delivering a range of outcomes — euthanasia in a weak sense — acceptable to the euthanasia lobby. If so, it achieves this by stealth. That is inappropriate to the doctor–patient relationship, which is one of trust. So there is a strong case for greater transparency. Moreover, there are limits to the acceptable outcomes which an unreformed criminal law can deliver and in a range of cases the criminal law condemns the doctor to impotence and the patient to a prolonged, miserable and undignified death. So there is also a case for going beyond the current law and legalising euthanasia in a strong sense. (shrink)
